Placement Partnerships

  1. This agreement is between you (you, your employees, business partners, associate partners and agents) and Hospitality Professionals (us, we, our) and relates to your participation in our partnership program.
  2. As a partner, you hereby agree to make monthly payments to Hospitality Professionals to receive agreed services.
  3. Placements are for positions up to $80,000 per annum inclusive of Super, benefits and Allowances. An additiona fee of $3,200 (GST exclusive) is due where a placement salary exceeds $80,000 per annum inclusive of Super, benefits and Allowances upon the placement date.
  4. You agree to keep confidential the confidential information of a candidate and/or employee and may only disclose it to personnel of the client engaged in the recruitment process.
  5. 90 day replacement guarantee applies from the successful candidate’s start date on the provision that:
    1. (a) Partnership fess are paid on time and not in arrears.
    2. (b) The terms and conditions of original employment, stated in the letter of offer or by verbal agreement, remain unchanged.
    3. (c) Replacements are available only in the Advertisement of original placement.
    4. (d) In the circumstance that the original position is not available for the replacement, we will endeavour to fill a similar position at a similar level. In the situation where the client has no positions to be filled with the replacement, the replacement guarantee will be available to the client for the period of 12 months only, from the final date of the client’s employment of the original candidate.
    5. (e) The replacement owing date is the final date of employment. Replacement guarantee expires 12 months from the replacement owing date.
  6. A placement is considered where the candidate is employed on a full-time, part-time or casual basis by you or a third party who was introduced to the candidate by you, irrespective of the period of service of the Employee.
  7. The client must indemnify us against all loss that you or we may sustain or incur during the period of engagement and engagement of any candidate.
  8. Any candidate which performs a trial will be paid at the casual rate for the position and will not exceed 4 hours. A trial which exceeds 4 hours is considered a placement.
  9. The final decision to recruit a candidate is your responsibility. Although we will work with you to make the choice for the appropriate position.
  10. Reciepts are emailed and can be posted upon request. It is the client’s responsibility to ensure the email provided to us is current.
  11. The client must pay direct debit or direct credit card unless otherwise agreed.
  12. You agree to commit as a member for a minimum of 12 consecutive months from the start of the partnership start date.
    1. (a) Payments must be made on the agreed monthly debit date.
    2. (b) There are no cancellations, hold periods or refunding during this time.
  13. After your 12 month partnership concludes, you agree to automatically renew your partnership which will continue for another 12 months.
    1. (a) If you wish to cancel your partnership after your first 12 months as a partner, you must give 30 days notice in writing, prior to the end of the agreement.
    2. (b) Any payments that are due within the 30 day notice period will still be due and payable.
  14. Should you at any time wish to change your partnership level you may do so at any time with 14 days’ notice in writing, under the conditions that:
    1. (a) Any scheduled debits within the 14 day notice period will still be due and payable in full.
    2. (b) Hospitality Professionals will NOT reimburse the rates difference if you choose to drop to a lower partnership level.
    3. (c) You can only change to a lower package, provided you have not exceeded the placements number in the lower package.
    4. (d) Any additional placements will be charge at the rate of the partner’s package per candidate with a one off payment.
  15. We reserve the right to cancel your partnership at any time should we deem it necessary.
  16. We may from time to time alter the partnership materials and/or structure of your partnership.
  17. You agree to adhere to all of the terms and conditions stated in this agreement.
  18. This agreement shall be governed by, construed and interpreted in accordance with the laws of the Country, State it is agreed.
  19. If any laws impose a change to the nature of any goods, services, consumption, Value added or similar tax your monthly partnership will be adjusted to reflect and include these.

Permanent placements

  1. This agreement is between you (you/client, your employee, business partners, associate members, body corporate and agents) and Hospitality Professionals (us, we, our, HP) and relates to our Placement services provided to you.
  2. The client acknowledges this agreement will remain in force until either party terminates it in writing with 7 days’ notice, after the exclusivity period has completed.
  3. This agreement is for ongoing services.
  4. Our Placement fees are $5,200 for placements up to $80,000 including salary package and $8,400 for placements $80,001 to $180,000 including salary package. Service fees stated are exclusive of GST. Salary package is Gross annual salary, superannuation, allowances and entitlements.
  5. The client agrees to an exclusivity period of 8 weeks for each position requiring a placement.
  6. Where the client requests additional screening (security or psychometric), we can arrange this with an additional service fee.
  7. The client agrees to keep confidential the confidential information of a candidate and/or employee and may only disclose it to personnel of the client engaged in the recruitment process.
  8. The client warrants equal employment opportunity principles will be adhered to by the client in so far as no unlawful discrimination will take place in job advertisements, job interviews, and the selection process.
  9. A 90 day replacement guarantee applies from the successful candidate’s start date on the provision that:
    1. (a) Payment for placement is to be received no more than seven (7) days after the commencement date of employment.
    2. (b) The terms and conditions of original employment, stated in the letter of offer or by verbal agreement, remain unchanged
    3. (c) Replacements are available only in the Advertisement of original placement
    4. (d) There is a limit of one replacement on any one previously invoiced placement
    5. (d) In the circumstance that the original position is not available for the replacement we will endeavour to fill a similar position at a similar level. In the situation where the client has no positions to be filled with the replacement, the replacement guarantee will be available to the client for the period of one year only, from the final date of the client’s employment of the original candidate
    6. (e) The replacement owing date is the final date of employment. Replacement guarantee expires 12 months from the replacement owing date.
  10. The client must pay us the placement fee where the candidate is employed whether on a full-time, part-time or casual basis by a third party who was introduced to the candidate by the client, irrespective of the period of service of the Employee.
  11. The client must indemnify us against all loss that you or we may sustain or incur during the period of engagement and engagement of any candidate.
  12. Any candidate which performs a trial will be paid at the causal rate for the position and will not exceed 4hours. A trial which exceeds 4 hours is considered a placement and the service fee applies.
  13. The final decision to recruit a candidate is the clients responsibility. Although we will work with you to make the choice for the appropriate position.
  14. Invoices are emailed and can be posted upon request. It is the clients responsibility to ensure the email provided by us is current.
  15. We will invoice the client on the commencement date. Payment for the invoice is to be received no more than seven (7) days for the guarantee to apply.
  16. The client must pay direct deposit, Credit Card, cheque or paypal unless otherwise agreed.
  17. The client agrees to the terms and conditions mentioned in this agreement.
  18. This agreement shall be governed by, construed and interpreted in accordance with the laws of the Country, State it is agreed.
  19. Hospitality Professionals can change this agreement at any time. Hospitality Professionals will give 7 days written notice of any change.
  20. By engaging with our services, you agree that you fully understand this agreement.

Labour hire

  1. This agreement is between you (you/client, your employee, business partners, associate members and agents) and Hospitality Professionals (us, we, our) and relates to our Labour Hire services provided to you.
  2. The client acknowledges Hospitality Professionals are not performing the services of workers, but instead the supplier of workers, at the clients request, to perform work that has been requested. For the period the worker reports to the client to commence their shift, the worker is under the care, control and supervision of the client until completion of shift.
  3. The Client indemnifies Hospitality Professionals for any fines or penalties imposed on Hospitality Professionals as a result of a breach of Workers Health and Safety laws by the client or workers under the clients supervision.
  4. Hospitality Professionals and the client agree that this agreement is for on-going services and can be cancelled at any time in writing. Where the agreement is cancelled, Hospitality Professionals will provide the client with a final invoice to be paid within 7 days.
  5. The client will ensure Hospitality Professionals have all the details for the job. This includes location, start and approximate finish times, position type, contact person, and directions if needed.
  6. The client must provide a safe work environment for Hospitality Professionals workers. This includes but not limited to supplying safety protection when working with equipment or tools.
  7. The client must obtain and maintain at all times whilst using Hospitality Professionals services the following.
    1. (a) Public liability insurance to provide cover for no less than $5,000,000; and
    2. (b) Third party and property damage insurance providing cover for no less than $5,000,000 on any equipment or vehicle the worker may use; and
    3. (c)Any other insurance required by legislation or by request of Hospitality Professionals
  8. The client will provide a copy of all mentioned insurance certificates of currency to Hospitality Professionals within 7 days of request.
  9. The Client must not enter into any relationship with any workers provided by Hospitality Professionals. If the Client would like to engage with a worker for any relationship, the client must first contact Hospitality Professionals for agreement. Where a direct relationship is entered by the worker and the client, the client is to pay a transfer fee of $4,500.00+GST immediately to Hospitality Professionals.
  10. The client will pay Hospitality Professionals for the services provided by workers, at a gross fee on an hourly unit rate basis as provided by Hospitality Professionals.
  11. Invoices are emailed and can be posted upon request. It is the clients responsibility to ensure the email provided by them is current.
  12. Hospitality Professionals will invoice the client on the first working day (usually Monday) after the week ending on a Sunday.
  13. The client must pay direct deposit, Credit Card, cheque or paypal unless otherwise agreed.
  14. Hospitality Professionals will provide a tax invoice upon receiving timesheets. The client will not withhold any payment if a tax invoice is not received for prior engagement.
  15. The client agrees to the terms and conditions mentioned in this agreement.
  16. This agreement shall be governed by, construed and interpreted in accordance with the laws of the Country, State it is agreed.
  17. Hospitality Professionals can change this agreement at any time. Hospitality Professionals will give 7 days written notice of any change.
  18. By engaging with us, you agree that you fully understand this agreement.
